Thanks to mental health advocacy, awareness of emotional support animals (ESAs) is on the rise in Arkansas. While by no means a stand-alone intervention, an ESA can play an integral part in an individual’s treatment plan when used alongside therapy and medication.
Emotional support animals are granted certain legal protections in Arkansas. These protections make it easier to navigate life with an ESA in the state.

Understanding Arkansas Emotional Support Animal Laws
Emotional support animals are distinct from service animals, which are trained to perform specific disability-relieving tasks. While ESAs are not considered working dogs like service animals, they are still legally recognized in Arkansas and are protected under specific laws.
Arkansas Emotional Support Animal Housing Rights
Arkansas complies with the federal Fair Housing Act (FHA). This law, which was enacted to prohibit discrimination in the purchase, sale, and rental of properties, covers those with disabilities and their assistance animals. This includes both service dogs and emotional support animals.
Under the FHA, owners with legally recognized ESAs receive the following protections:
- Reasonable accommodation in virtually all forms of housing, regardless of whether there’s a no-pet policy (ESAs aren’t pets). There are very few exceptions to the FHA.
- Complete exemption from pet-specific charges, such as pet rent and extra security deposits, as well as pet regulations like weight and breed limits.
It is rare for an ESA to be denied their housing rights. As long as your ESA can be safely accommodated and they do not pose a threat to others living there, you aren’t likely to run into any problems. You must also have an official prescription (a valid ESA letter).
Certain property types are exempt from the FHA, so be mindful of this as you browse rental listings. This includes owner-occupied properties with four or fewer units and housing owned by private organizations.
Arkansas Emotional Support Animal Public Access Laws
Emotional support animals do not receive public access rights in Arkansas. The Americans with Disabilities Act (ADA), which entitles service dogs to public access, does not extend these protections to ESAs. Arkansas also hasn’t introduced any state-level legislation that gives ESAs this accommodation.
Arkansas ESA Travel Protections
Unfortunately, ESAs also do not receive additional travel protections. Modes of transport like trains, buses, and taxis fall under public access, meaning accommodation is not legally mandatory. Most travel agencies have opted to treat them as pets, so standard pet rules and fees apply.
ESAs, at one point, did receive air travel protections under the federal Air Carrier Access Act (ACAA). They were allowed to fly with their owner in the plane’s cabin regardless of the airline’s stance on pets, and with exemption from pet fees and pet size restrictions. Sadly, the ACAA was updated in 2021 to exclude ESAs. It now only protects service dogs.
What Makes an ESA Legally Recognized in Arkansas?
To benefit from the FHA housing protections, your ESA must be legally recognized in Arkansas. This is not as simple as stating your ESA provides you with therapeutic support. A licensed mental health professional (LMHP) who practices in the state must prescribe you an ESA. This prescription comes in the form of a document known as an ESA letter.
There are also specific requirements in Arkansas compared to other ESA state laws. Here’s a quick look at what the process involves:
- Confirm You Have a Qualifying Mental Health Disability. This includes conditions recognized in the DSM-5, like depression, anxiety, and post-traumatic stress disorder (PTSD).
- Connect With a State-Licensed Mental Health Professional. You must have at least a 30-day client-provider relationship with them before you can be evaluated for an ESA. This wait period is enforced under Arkansas law.
- Arrange for an ESA Evaluation Appointment. After the 30-day period, schedule an evaluation. During the ESA evaluation, the LMHP will assess your needs to determine whether the treatment is suitable for your well-being.
If an ESA is deemed beneficial, they will write you an ESA letter prescription. This confirms your ESA is legally valid and entitles you to the FHA protections.
The ESA letter will be printed on official letterhead and will note the practitioner’s license information, signature, and contact details. It will state that you have a qualifying mental health disability and have a legitimate, legal need for an ESA in Arkansas. Your privacy will be protected; specifics of your disability or the nature of your symptoms will not be discussed in the letter.
